CMS Finalizes Medicare Advantage Marketing Reforms

On April 5, 2023, the Centers for Medicare and Medicaid Services (CMS) issued a final rule revising the regulations governing the marketing of Medicare Advantage (MA) and Medicare Part D plans. The final rule targets deceptive marketing practices that have been a notable topic of concern for CMS. The final rule includes reforms such as prohibiting the use of Medicare logos in a way that is misleading, confusing, or misrepresenting; requiring agents to explain the effect of an enrollee’s enrollment choice on their current coverage status; banning ads that do not mention a specific plan name or that use words, imagery, or language that may be confusing to consumers; and informing enrollees annually, in writing, of their ability to opt out of phone call solicitations.
