On April 5, 2023, the Centers for Medicare and Medicaid Services (CMS) issued a final rule revising the regulations governing the marketing of Medicare Advantage (MA) and Medicare Part D plans. The final rule targets deceptive marketing practices that have been a notable topic of concern for CMS. The final rule includes reforms such as prohibiting the use of Medicare logos in a way that is misleading, confusing, or misrepresenting; requiring agents to explain the effect of an enrollee’s enrollment choice on their current coverage status; banning ads that do not mention a specific plan name or that use words, imagery, or language that may be confusing to consumers; and informing enrollees annually, in writing, of their ability to opt out of phone call solicitations. Plans marketing for 2024 enrollment will be required to comply with these new requirements. Read the rule here.
