Following the March 28, 2019 ruling that invalidated the regulations that allowed for the expansion of Association Health Plans (AHPs), Vermont insurance regulators have issued new guidance titled, “Impact of Federal District Court Ruling in State of New York v. United States Department of Labor on Vermont Association Health Plans.” This guidance halts the approval of additional plans and bars existing plans from enrolling new members. The Vermont Department of Insurance Regulation has stated that, until the District Court’s ruling is either stayed or vacated, the agency lacks the legal authority to approve new plans.
