On June 14, 2023, Aimed Alliance sent a letter to the Federal Trade Commission (FTC) urging the Commissioner to take appropriate enforcement action against non-essential health benefit (non-EHB) and alternative funding programs. The letter provides a explanation of the reasons why the FTC holds the authority to regulate these unjust trade practices, and alleges that non-EHB and alternative funding schemes meet the criteria for unfair trade practices, as defined by the FTC Act.
In addition to outlining the legal basis for regulatory intervention, the letter emphasizes the harmful consequences of such programs on consumers. Recognizing the duty of the Commissioner to protect and safeguard consumers, Aimed Alliance also requested a meeting with the Commission to discuss the role of the FTC in shielding consumers from the adverse effects of non-EHB and alternative funding schemes.
