U.S. Attorneys General Appeal 5th Circuit Decision in Texas v. Azar Finding Parts of ACA Unconstitutional to the Supreme Court of the United States

On January 3, 2020, a coalition of 20 U.S. Attorneys General filed an appeal of a recent decision by the U.S. Court of Appeals for the Fifth Circuit in Texas v. U.S. The decision affirmed the lower court’s holding that the individual mandate provision of the Patient Protection and Affordable Care Act (ACA) was no longer a constitutional exercise of Congress’s taxing power, but refused to rule on the validity of the rest of the ACA and remanded the case to the lower court. The appeal calls on the Supreme Court to review this “life-changing” decision before the end of the Court’s current term in June 2020.
