On March 23, 2026, the FTC and CVS Caremark jointly moved to withdraw from the administrative proceeding to allow the Commission to consider the proposed consent agreement. The proceeding stems from the FTC’s September 2024 lawsuit alleging that major pharmacy benefit managers, including CVS Caremark, Express Scripts, and OptumRx, engaged in anticompetitive and unfair rebating practices that inflated insulin prices. The terms of the agreement, which remain confidential, follows the FTC’s February 2025 settlement with Express Scripts, which required significant reforms to rebate pricing practices.
