Trump Administration Suspends Mental Health Parity Enforcement Amid Legal Challenge

The Trump administration has paused enforcement of the 2008 Mental Health Parity and Addiction Equity Act, which requires insurers to provide equal coverage for mental health/substance use disorders and medical/surgical care, and is weighing whether to repeal the rule entirely, according to a U.S. Department of Justice (DOJ) court filing. The decision follows a lawsuit filed in January by the ERISA Industry Committee (ERIC), ERIC v. U.S. Department of Health and Human Services et al., No. 25-00136, in which ERIC claims the rule restricts their ability to offer affordable health benefits.
