With PHE to End Mid-May, DEA Prepares to Propose New Telehealth Rules

On January 30, 2023, the Biden Administration announced that the COVID-19 public health emergency (PHE) will end on May 11, 2023. The PHE was originally set to expire on April 11, but the Administration announced its plan to extend the emergency declaration to prevent an abrupt end to policy flexibilities enacted during the PHE. The Biden Administration warned that without the PHE extension “millions of patients, including many of our nation’s veterans, who rely on telehealth would suddenly be unable to access critical clinical services and medications.”

To address these eventual policy changes, the Drug Enforcement Agency (DEA) announced that it would release proposals for the prescription of controlled substance for mental health and substance use disorder treatment via telehealth. For individuals who began receiving treatment via telehealth, it is critical to understand if they will have an in-person requirement once the PHE ends — if so, this is something patients and providers will need to begin planning for as soon as possible.
