On January 30, 2023, Aimed Alliance submitted a comment to the Centers for Medicaid and Medicare Services (CMS) and the Department of Health and Human Services (HHS) regarding their request for information on essential health benefits. Our comment highlighted the need for CMS and HHS to clarify that specialty drugs are included within the essential health benefit of prescription drugs, and recognized that CMS should not rely solely on formal appeals and complaint mechanism to determine if consumers are experience barriers in accessing essential health benefits. Because many consumers are unaware of their right to appeal health benefit denials, Aimed Alliance urged CMS and HHS to consider the input provided by patient advocacy organization that work directly with impact individuals to ensure CMS and HHS have a wholistic understanding of challenges in accessing essential health benefits.
