Healthcare advocacy groups, including the National Health Law Program, have filed administrative complaints against the Department of Health and Human Services’ Office for Civil Rights and the Department of Justice alleging that the Medicaid redetermination process in Washington D.C., Texas, and Colorado are violating the Americans with Disabilities Act (ADA). The complaints allege these state programs are providing inadequate access to coverage and implementing an exclusionary renewal processes for individuals with disabilities. Specifically, the D.C. complaint focuses on an inaccessible renewal system, while the Texas complaint, alleges a burdensome renewal procedures and misinformation from call centers. Lastly, the Colorado complaint alleges errors in a new case management system affecting approximately 6,000 residents.
