Senate HELP Committee Votes to Advance PBM Reform Act

The Senate Health, Education, Labor, and Pensions (HELP) Committee voted 18-3 to advance the Pharmacy Benefit Manager Reform Act of 2023 out of the Committee. The Pharmacy Benefit Manager Reform Act of 2023 would impose transparency measures on Pharmacy Benefit Manager (“PBMs”), ban spread pricing, and mandate that PBMs pass 100 percent of the rebates collected to health plans. This bill also includes, the Safe Step Act, which would require health plans to have clear procedures and exemptions for step therapy protocols. Unfortunately, while the HELP Copays Act was proposed as an amendment to the Pharmacy Benefit Manager Reform Act, it was ultimately excluded from the bill because it did not have a Congressional Budget Office (“CBO”) score, a procedural requirement for all amendments during the hearing.
