New Resources for Consumers & Employers: DC Decision Bans Copay Accumulators

On September 29, 2023, the United States District Court for the District of Columbia held that the 2021 NBPP, which permitted the use of copay accumulators, would be set aside because it was arbitrary and capricious. As a result of the 2021 NBPP being set aside, the law reverts to the requirements in the 2020 NBPP which only permits copay accumulators for brand-name medications with a medically appropriate generic equivalent available. Copay accumulators are prohibited in all other circumstances. To ensure, consumers can benefit from this change in the law in 2024, Aimed Alliance has partnered with the Crohn’s and Colitis Foundation to develop the below resources:
