Nebraska Passes Step Therapy Law

On March 31, 2020, Nebraska Governor Pete Ricketts signed LB337 into law, which strengthens protections for patients who are subject to step therapy by their insurer. The law limits health plans’ use of step therapy requirements in favor of patient access and individualized care. For example, the law requires health plans to use evidence-based and peer review criteria in make any utilization decisions. The law also required health plans to approve a step therapy protocol exception request if an individual has tried and failed on the required treatment while enrolled in their current or previous health plan or is receiving a positive therapeutic outcome on the current prescription
