Minnesota Board of Pharmacy Files Civil Lawsuit against Northland Vapor

On December 5, 2022, the Minnesota Board of Pharmacy announced that it filed a civil lawsuit against three limited liability companies known collectively as “Northland Vapor.” The lawsuit alleges Northland Vapor violated Minnesota’s edible cannabinoid laws, which provide that an edible cannabinoid product sold in Minnesota cannot contain more than five milligrams of hemp-derived THC in a single serving, or more than a total of 50 milligrams of any THC per package. The laws also provide that an edible cannabinoid product cannot resemble a real or fictional person, animal, or fruit that appeals to children and cannot be modeled after brands primarily consumed by or marketed to children.

An investigation of Northland Vapor’s products revealed packages containing 2,500 milligrams of THC, products resembling characteristics of a fictional bear, and products modeled after common gummy bear candies marketed to children. Northland Vapor also failed to provide the Board of Pharmacy with testing results to show whether their edible cannabinoid products contain prohibited substances. The U.S. Food and Drug Administration (FDA) contacted the Board of Pharmacy to conduct a joint investigation. The FDA has already received several complaints about serious adverse events associated with Northland Vapor’s “Death by Gummy Bear” delta-9 THC products. The Minnesota Board of Pharmacy embargoed these products valued at over $7 million. The Board of Pharmacy is seeking a court order to destroy these products and prevent Northland Vapor from manufacturing and selling edible cannabinoids that violate the law.
