On October 31, 2019, the Indiana Family and Social Services Administration (FSSA) announced that enforcement of the state’s Medicaid work requirements will be suspended, pending a legal challenge that has been brought against the state in federal court. This follows a similar announcement from Arizona on October 17, 2019.
The suit, Rose v. Azar, was filed in the U.S. District Court for the District of Columbia on September 23, 2019 and challenges the Gateway to Work program and several parts of the Healthy Indiana Plan. This development is notable because the current Administrator of the Centers for Medicare & Medicaid Services (CMS), Seema Verma, was the architect of the Healthy Indiana Plan when it was originally enacted in 2015. In its press release, FSSA announced that enforcement of the Gateway to Work Program would be suspended to ensure that the Healthy Indiana Program could continue to operate while the work requirements are challenged in court. While enforcement of the work requirements is suspended, FSSA encourages Medicaid enrollees to continue reporting their activities to the state so they can be connected to resources, such as job training and advancement programs.
