Fifth Circuit Pauses Ruling That Threatened ACA Preventive Health Care

On May 15, the Fifth Circuit Court of Appeals agreed to temporarily stay the lower court’s decision in Braidwood Management v. Becerra. The lower court’s ruling overturned the Affordable Care Act’s preventative services mandate which currently requires health plans to cover certain preventative care services with no cost-sharing. The lower court’s decision jeopardizes access to these preventative services, as without this mandate coverage coverage of these services would be subject to each plan’s policy. However, the Fifth Circuit Court of Appeal’s stay will ensure that plans will continue providing full coverage for preventive services until the Appeal is reviewed on the merits.
