The U.S. Department of Justice (DOJ) has sued a North Carolina hospital system, accusing it of using contract restrictions that prohibit commercial health insurers in the Charlotte area from offering patients financial benefits to use more affordable health care services offered by the hospital system’s competitors. Moreover, the complaint alleges the hospital system has a 50 percent share of the acute inpatient hospital care market in the affected area, essentially conferring market power on themselves.
