CMS Lowers Out-of-Pocket Costs and Expands Special Enrollment Periods

On April 30, 2021, the Centers for Medicare and Medicaid Services (CMS) released the second part of the 2022 Notice of Benefit and Payment Parameters (NBPP) Final Rule. The new part of the rule includes several provisions to help consumers distinguish between plan options, qualify for additional special enrollment periods (SEPs), and reduce patients’ out-of-pocket cost-sharing. The maximum out-of-pocket limit is now $400 lower than what CMS originally proposed. Additionally, under the SEP expansion, consumers can sign up for health coverage when they did not receive proper notice of their eligibility or if they no longer receive employer contributions or government subsidies.
