All Copays Count Coalition Sends Letter to State Insurance Commissioners

On July 1, 2019, Aimed Alliance joined the All Copays Count Coalition in sending a letter to state insurance commissioners requested that they enforce a new federal rule that was finalized by the Centers for Medicare & Medicaid Services earlier this year regarding copay accumulator policies. The new rule will require that third-party financial assistance count towards plan enrollees’ deductibles and maximum out-of-pocket costs when they fill prescriptions for brand medications that do not have generic equivalents. This rule will allow copay accumulator programs to function in limited situations where a patient fills a prescription for a brand medication that has a generic equivalent. The letter also notifies the insurance commissioners about laws passed in Virginia and West Virginia that could serve as models for other states looking to regulate copay accumulator policies.
