On January 27, 2022, Aimed Alliance submitted a comment to the Department of Health and Human Services (HHS) and the Centers for Medicare and Medicaid Services (CMS) on the 2023 HHS Notice of Benefit and Payment Parameters for 2023 (NBPP). Aimed Alliance supported HHS clarifying the following: discrimination based on sex includes discrimination based on sexual identity and gender identity; strengthening essential health benefit protections and addressing discriminatory benefit designs; ensuring that health plans do not improperly incentivize virtual versus in-person healthcare visits; tracking how technology in healthcare can play a role in ensuring network adequacy requirements; and standardizing health plans offered on the federal exchange. In addition, we urged HHS and CMS to take action to prohibit copay accumulator programs in the final 2023 NBPP and to ensure that all contributions on behalf of a patient count to their deductibles and annual out-of-pocket limits.
