FDA and FTC Target Illegal Delta-8 THC Copycat Foods

On July 16, 2024, the U.S. Food and Drug Administration (FDA) and the Federal Trade Commission (FTC) issued warning letters to five companies for illegally selling copycat food products containing delta-8 THC, in violation of the Federal Food, Drug, and Cosmetic Act. These products are especially concerning because their packaging closely mimics popular snacks, increasing the risk of accidental ingestion by children. Moreover, delta-8 THC may contain impurities or discrepancies in the composition, potentially leading to products that may be harmful or have unpredictable effects on consumers. These warnings are part of a joint effort by the FDA and FTC to crack down on illegal delta-8 THC copycat foods. Read the FDA’s press release.
