Federal Agency Initiates First Enforcement Action Over Inaccessible Medical Records

Bayfront Health of St. Petersburg, FL became the first HIPAA-covered entity to be sanctioned by U.S. Health and Human Services Office of Civil Rights (OCR) under the agency’s new Right to Access Initiative. This initiative was launched earlier this year to improve the ability of patients to access their medical records and to increase compliance with HIPAA regulations that require covered entities to provide a patient a copy of the medical records within 30 days of receiving a request. Bayfront Health took over nine months to fulfill a patient’s request for a copy of her records. As a result, Bayfront Health agreed to settle the claim by paying an $85,000 fine and instituting a corrective action plan, which will be monitored by OCR for the next year.
